Hearings for Wegmans and Terrain in Concord

Concord Township Council held conditional use hearings for Terrain Café and Wegmans Tuesday night and decisions are expected in November.

First up was Terrain. The garden shop at Route 1 and Evergreen Drive has an indoor dining area but went to the council for a hearing to get permission for an outdoor dining area that would seat about 82 people. But much of the discussion concerned a new driveway and point of ingress and egress.

The current access point is along Evergreen toward the northern end of the shop. However, that point is right in, right out. The proposed new access point would be a little farther south on Evergreen and would allow for left turns.

A point of concern, brought up by Council Co-vice President John Gillespie, is that the proposed new ingress/egress point does not line up directly with the driveway into the town center on the other side of Evergreen Drive. Traffic engineer Greg Richardson said they would look at that again to see if the two access points can be lined up better.

Immediately after that hearing came a hearing for Wegmans. The supermarket wants to extend the hours of take-out beer and wine sales.

There were no witnesses in the matter, only the legal argument from attorney Ellen Freeman, who is representing Wegmans. She told council members that the Concord store is losing about 100 sales per month compared to the company’s other 17 stores in Pennsylvania that have slightly longer beer and wine sales hours.

She said the Concord Wegman operates beer- and wine-to-go sales from 9 a.m. to 10 p.m. on Sundays, 8 a.m. to 10 p.m. on Monday through Thursday, and from 8 a.m. to 11 p.m. on Friday and Saturday. However, now the company wants to amend what was previously approved in 2015 and extend those hours.

Those requested hours are 9 a.m. to midnight on Sundays, and 7 a.m. to midnight Monday through Saturday. She said those are the hours allowed by the Pennsylvania Liquor Control Board, and closer to the hours the store is open for business. Wegmans opens at 6 a.m.

Freeman added that Wegmans would likely be happy with maintaining an 11 p.m. cutoff time for alcohol sales.

No decisions were made during Tuesday’s hearing. Council President Dominic Pileggi said they would be announced at the November meeting, scheduled for Wednesday, Nov. 8. The meeting is Wednesday because Tuesday, Nov. 7 is election day, and the meeting room is used for voting.

Police Log Oct. 11: Fatal DUI, assault

Pennsylvania State Police said Elaine McQuillin, 67, of West Chester, was killed in a two-car crash in Pocopson Township on Oct. 3. A juvenile passenger in McQuillin’s vehicle was injured, transported to a trauma center, and later released. The police report said she was pronounced dead at the scene of the accident, Lenape Road just north of Overlook Circle. The other driver, identified only as a 24-year-old man from Kennett Square, was also injured and transported to a trauma center for life-threatening injuries. Police said the man was driving south on Lenape Road but crossed over into the northbound lane, striking the oncoming car. He is suspected of DUI, according to the report. The accident happened at approximately 8:14 p.m.

A disabled vehicle led to the arrest of a 19-year-old woman in Pennsbury Township on Oct. 8. Details were not released, but the report said the young woman was arrested for DUI with alcohol in view. The arrest came at 2:42 a.m. on S. Creek Road.

A 53-year-old woman from Thorndale was arrested for DUI following a traffic stop on E. State Street at Wickersham Lane in East Marlborough Township shortly before 1 a.m. on Oct. 7. The report said traffic violations were the reason for the traffic stop.

A single-car crash on Route 1 in Pennsbury Township led to the arrest of a New Jersey man for DUI and endangering the welfare of a child. Police said the man, not identified other than he’s 38 years old and from Paulsboro, was heavily intoxicated when they arrived at the scene of the crash, Route 1 and Pennsbury Way. In the car with him was a 32-year-old woman, also from Paulsboro, and a 2-year-old girl. The accident happened on Oct. 1 at approximately 10:30 p.m.

A 22-year-old woman from Philadelphia was arrested for DUI with drugs in Kennett Township on Oct. 3. The arrest came at 11:08 p.m. According to the report, police initiated a traffic stop on Lenape Road at Route 1, for vehicle code infractions. After making contact with the driver, police detected a strong odor of marijuana. Drug paraphernalia was observed in plain view, and the operator admitted to having recently smoked marijuana. Field sobriety tests were administered and they indicated impairment, so the driver was taken into custody.

Kennett Square Police Department

A police report said Andrew Jackson, 35, was charged with simple assault, harassment, and disorderly conduct, following an altercation in which he allegedly struck a woman in the face causing a small laceration near her mouth. The incident occurred on Sept. 29, at approximately 6:39 p.m. in the 300 block of E. Linden Street. Jackson was taken into custody and transported to Central Booking at Chester County Prison. Charges were filed at District Court 15-3-04. The case is pending a preliminary hearing.
