Chadds Ford intervenes in Ridge Road suit

Chadds Ford Township has filed a petition to intervene in the latest round of litigation involving the proposed Shops at Ridge Road and associated road improvements. The petition was filed Monday, Oct. 30.

Several Chadds Ford residents expressed concern that they had lost representation in the matter when the first suit was dismissed and the second did not include Chadds Ford as a defendant.

The petition requests the court to allow Chadds Ford to intervene in the matter as a party defendant, as the township had been joined to the original suit. It also requests that the suit be dismissed with prejudice since it violates state rules of procedure.

Among those violations, is that the suit fails to join PennDOT to the suit. PennDOT, the petition asserts, is an indispensable party since the department has final say over the proposed highway improvements.

Ridge Road Development — the Pettinaro Construction subsidiary that wants to build the shopping center — has until Nov. 20, to respond, according to the filing.

Both suits — the original that was filed in May and later dismissed, and the second, which was filed Sept. 29 — center around one specific condition that Concord Township granted to Ridge Road Development to build the shopping center at the southwest corner of Route 202 and Ridge Road. That condition, Condition 19, requires that Chadds Ford Township agrees in writing that proposed changes to Ridge Road — widening the road to six lanes between Route 202 and the end of the subject property, and that the main entrance to the center be located on Ridge Road — are satisfactory.

Chadds Ford Township Supervisors’ Chairman Frank Murphy has said that he won’t sign off on the changes until Chadds Ford residents’ concerns over road safety and increased traffic are addressed.

The Sept. 29 filing named only Concord Township and Concord’s Township Council as defendants. Concord has not yet responded. Concord’s solicitor Hugh Donaghue said last week that he filed for an extension of time in which to respond and that he was waiting for instructions from the council.

Ridge Road Development originally named only Concord in the first complaint, then amended that to include Chadds Ford. Judge Spiros Angelos dismissed that suit because the plaintiff did not include PennDOT.

Chadds Ford Township supervisors scheduled a Nov. 15 resident forum on the matter. That meeting begins at 7 p.m.

Edward A. McCormack, 82, of Chadds Ford, and formerly of Media, died Monday, Oct. 30.

Beloved husband of the late Helen (nee Maxwell) McCormack; loving father of Elizabeth O. Kynett (Bill), Rosalind A. Keser (Ken), and Mark W. McCormack (Kathy); devoted grandfather of Erin, Cameron, Andrew, Sean, Brian, James, and Joseph; dear brother of Dolores Burns and Arthur McCormack; predeceased by brothers William and Frederick McCormack.

Edward worked in research and development in the engineering industry. He loved inventing things and had over 20 patents. He enjoyed animals, especially dogs. Edward enjoyed cruises and traveling to Italy and Scotland.

Relatives and friends are invited to his Visitation 11 a.m to noon, Friday, Nov. 3, at The Donohue Funeral Home, 1627 West Chester Pike, West Chester, PA 19382, 610-431-9000, followed by his funeral service. Interment will be at SS Peter & Paul Cemetery.

Police Log Nov. 1: Burglary, retail theft, DUIs

• A 36-year-old woman from Merchantville, N.J., is the subject of a retail theft investigation. State police from the Media barracks said the unidentified woman tried to return merchandise to the Charming Charlie store on Route 1 in Concord Township. The merchandise was previously stolen, the report said.

• An 87-year-old man was scammed as he was trying to buy a boat online. A police report said the victim, of Concord Township, believed he was buying the boat through eBay but was scammed in the process. He paid an unknown amount of money via gift cards, but never got the boat.

• Police said Ryan N. Razler, 20, of Marlton, N.J., was charged with careless driving after he rear-ended a car that had stopped for a light on Conchester Road near Route 1. The car he hit was forced into a third vehicle, police said.

• Someone cashed four checks belonging to an 85-year-old Maris Grove resident. Police are investigating.

• Police said someone stole two pieces of brass, weighing a total of 500 pounds, from Hanson Aggregates in Concord Township. The value of the brass is approximately $850.

• Sometime between Oct. 9 and 16, someone cut the lock to a storage container at 6 Fairville Road in Pennsbury Township and stole 80 car batteries. Police said there was no other damage done to the property.

• Police said Robert Joseph Muscella, 18, of Oxford, was taken into custody on retail theft charges after he tried stealing an Xbox controller from the East Marlborough Township Walmart on Oct. 28.

• Theft of service charges were pending against Farhad Emami, 44, of Kennett Square, a police report said. According to police, the accused failed to pay for services received from Mavis Discount Tire of Chadds Ford.

• A state police report from the Media barracks said Kimberly Ardary, 38, of Aston, was arrested for retail theft following an incident at the Target store in Concord Township on Oct. 29 at 3:18 p.m.

• Also arrested for theft at the Target store on Oct. 29 was Linda Walsh, 50, of West Chester, police said. She was arrested at 6:50 p.m.

• State police from the Avondale barracks said Richard Aurite, 35, of Oxford, struck another vehicle on Baltimore Pike near Constitution Drive in Pennsbury Township, causing injury and vehicular damage. Police released the report Oct. 31, but the accident happened in June. According to police, the accused tried to flee but was found nearby passed out behind the wheel of his damaged vehicle of an apparent opioid overdose. He was revived with four doses of Narcan, police said. Blood tests later showed Fentanyl and Norfentanyl in his system.

• Haruko Taylor Lewis, 27, was found with marijuana in his possession following an Oct. 12 traffic stop on Route 1 near Route 52, police said. Police made the stop at 11:55 p.m.

• Amanda Brown, 19, of Wilmington, was arrested and charged with violations of the Controlled Substance, Drug, Device, and Cosmetic Act after she was found to be in possession of marijuana and related drug paraphernalia, according to Southern Chester County Regional Police. The incident occurred Oct. 14 shortly after 9:03 p.m., in the 100 block of Salasin Drive, in New Garden Township. Upon making contact with Brown and a juvenile passenger, police said they immediately detected the odor of marijuana coming from the vehicle.

• Police said Jose Ayala-Sedano, 36, and Michael Marcozzi, 42, both of Wilmington were arrested on Oct. 15 and charged with multiple counts of retail theft, criminal conspiracy, and related offenses, stemming from their alleged involvement in several retail thefts that occurred at the CVS store, at 730 Newark Road, in New Garden Township.

• Benjamin Chun Vasquez, 25, of Avondale, was arrested and charged with DUI and related traffic offenses, following a one-vehicle crash into a pole on Church Road in New Garden Township, a police report said. The incident occurred Oct. 15 at 5:58 p.m. Police said they made contact with Vasquez as medics were attending to him. Witnesses at the scene identified him as the driver.

• According to Southern Chester County Regional Police, Daniel Hernandez-Perez, 20, of Toughkenamon was arrested and charged with DUI and related offenses, following 1:34 a.m. traffic stop for erratic driving. The incident occurred on Oct. 17 in the area of Newark Road and Willow Street, in New Garden Township. Police said they took him into custody after he failed field sobriety tests.
