Concord upholds Pettinaro condition

Concord Township Council Tuesday night upheld a nine-year-old condition for a commercial development that borders Chadds Ford Township. That condition requires the developer, the Pettinaro Co., to have Chadds Ford sign off on PennDOT approved highway improvements.  But the decision to keep the condition could lead to legal action.

The vote was 4-0, with Council President Dominic Pileggi abstaining. Pileggi is the owner of Olde Ridge Village, a shopping center across from the property in question.

Carolyn Daniels was one of at least 10 Chadds Ford residents who attended Concord’s meeting. In an email after the meeting, she said the decision “provided us with an important victory.”

Tom Singer, a member of Chadds Ford’s Planning Commission also called it “good news,” and Frank Murphy, Chadds Ford’s supervisors’ chairman, said he was glad Concord upheld the condition. Murphy is already on record as saying he won’t sign off on the highway improvements until Chadds Ford concerns over traffic are addressed. 

At issue is the commercial development known as The Shops at Ridge Road, planned for the 25-acre parcel on the southwest corner of Ridge Road — across from Olde Ridge Village — and Route 202. Concord Township approved the plan in 2008 and then reaffirmed it, and the condition, in 2014.

Of primary concern for Chadds Ford is that the main entrance and exit for the development would be on Ridge Road and that Ridge would be widened from two to six lanes along the depth of the shopping center.n

On Jan. 4 of this year, Murphy wrote to Pettinaro’s land development manager referencing those concerns, saying “Chadds Ford has not and will not issue any approval until such time as the items of concern are addressed.”

In February, Supervisor Noelle Barbone wrote to PennDOT Traffic Services Manager Fran Hanney, asking PennDOT to require Pettinaro to conduct a brand new traffic study.

Pettinaro will likely go to court over the condition that, according to attorney John Jaros, puts the company in “an impossible position” while describing a proverbial “Catch 22” or “rock and a hard place” situation.

He told Concord Council members that Chadds Ford can’t approve or disapprove of the development because it’s in Concord Township. Further, he said, his client doesn’t need a letter from Chadds Ford because Chadds Ford officials have already given “tacit approval” for the highway changes.

Jaros presented four documents, a highway occupancy permit, a traffic signal easement agreement, a PennDOT highway occupancy permit stormwater maintenance and operation agreement as well as a highway occupancy permit extension that were signed by current Chadds Ford employees and former supervisors. The last one was signed in 2016.

“Chadds Ford has already given tacit approval by signing those agreements,” Jaros said after the meeting. “You don’t sign them without agreeing.”

Concord won’t release the final plan for actual development until Chadds Ford signs off on the highway improvements, but Chadds Ford supervisors won’t sign off acknowledging satisfaction with those improvements.

“I may have to ask the court to resolve this,” Jaros said.

No decision will be made on whether to file a suit until Jaros talks with his client.

Police searching for missing teen

The Southern Chester County Regional Police Department is investigating a report of missing juvenile who is a voluntary runaway.

The parents of 15-year-old Daniela Hetzel Rojas-Bergara, of New Garden Township, told police on Monday, March 6, that heir daughter had not returned home from school on Friday, March 3. The juvenile was last seen at Kennett Area High School in the company of friends.

During this time, Rojas-Bergara has communicated on social media that she is okay but her whereabouts are unknown at this time. It is believed she is in the Kennett Square/Avon Grove area of Southern Chester County.

Investigators are actively attempting to locate the juvenile and request that anyone with information about her whereabouts contact the police at 610-268-3171.

Rojas-Bergara has long brown hair and a thin build.

While no criminal conduct has been revealed in the early stages of the investigation, police will consider interference with the custody should evidence support someone harboring the missing juvenile.

Harold “Hal” Lane Wagner of Avondale

Harold “Hal” Lane Wagner, 78, of Avondale, died Saturday, March 4, at his home surrounded by family.

Born in West Chester, he was the son of the late Charles F. and Margaret F. Anderson Wagner.

He graduated Kennett High School in 1957 where he was a baseball pitcher and earned the nickname “Honus.” He was also an active member of their FFA program. Harold was a life-long farmer and lived the majority of his life on the family’s century farm on Hillendale Road. Harold was famous for joke telling and his quick wit. He made an impact on everyone he met. Harold regularly had coffee with friends before starting his busy day. In his 40s, Hal picked up golfing and joined the Over the Hill Gang golf group. It wasn’t allowed to rain on Thursdays, his weekly golf day. Hal had a passion for Oliver tractors and began collecting and restoring them. For the past 10 years, he enjoyed spending winters in Florida with friends and his brother, Wayne.

Survivors include his only daughter, Julianne Wagner Desmond and her husband Darren of Phoenix, Az.; his brother, C. Wayne Wagner and his wife Terry of Wilton, N.H.; four grandchildren, Sarah, Katie, Maggie and Darren Jr., along with many nieces and nephews who he adored. To many in the family, he was known as “Uncle Bear.”

Paul A. “Bob” Geary Jr. of Chadds Ford

Paul A. “Bob” Geary Jr., 73, of Chadds Ford, died peacefully Sunday, March 5. Beloved husband of 52 years of Ann Marie Geary (nee ColDepietro), devoted father of Paul III (Kathryn), Sean (Akemi), Ann Marie Pinola (Richard), Brenda Geary-Deitz (Tom), Janice Prodoehl (John) and Brendan (Jasmine); dear brother of Mark Geary and Monica Simpson; also survived by 12 grandchildren.

Paul was born in Monroe, La., on August 5, 1943, son of the late Paul and Monica Geary (nee McKernan). He spent most of his life residing in Media and Chadds Ford. Paul attended Nativity BVM Grade School, St. James High School and then went on to college at the University of Notre Dame. Upon graduation, Paul married the love of his life, Ann Marie. Together, they raised six children and have been blessed with 12 grandchildren.

Paul’s career began with McKesson Chemical Company shortly after he graduated college. He later moved to East Falls Chemical Corporation. After the sale of East Falls, Paul and his son Sean founded GWR Medical, Inc. in 1996. Together they pioneered Topical Oxygen Therapy to help treat individuals suffering from open wounds and burns around the world.

Outside of work, Paul dedicated endless hours to charities and organizations. Perhaps his greatest passion was giving back to the University of Notre Dame. He sat on the National Alumni Board of Directors for the University and served as President of the Notre Dame Club of Philadelphia. He and his wife, Ann Marie, hosted 13 years of send-off gatherings at their home for newly accepted Notre Dame freshman class members as an avenue for new students to meet one another.

Paul enjoyed family life and being a great dad. He was active in all his children’s lives, coaching sports at youth levels and supporting them at all their high school functions. Paul loved celebrating the holidays with his children and grandchildren each year at his home. St. Patrick’s Day held a special place in his heart, as he hosted the annual “best leprechaun” costume contest each year for his grandchildren.

An avid fly fisherman, Paul enjoyed traveling the country and fishing in Montana, Yellowstone and Upstate New York. He shared his passion with his children and grandchildren, taking them on fishing adventures. Paul also shared in countless trips to his beloved Ireland, traveling the countryside and enjoying a pint with his sons and any stranger he could strike up a conversation with at the local pub.

Patricia A. Reed

Patricia A. Reed (nee Magarine), 88, of Glen Mills, died Monday, March 6. Born in Brooklyn, NY, she was the daughter of the late Ralph and Helen Magarine (nee Curry). Patricia was employed as a buyer for R.H. Macy’s in Long Island, N.Y. She retired in 1990.

Patricia was predeceased by her beloved husband, John J. Reed. She is survived by her loving daughters, Debbie DiBiagio (Steve) and Donna Dickey (Gary), her grandchildren Ryan, Kristin, Christina, Alyson and Jennifer and her great-grandchildren Cooper, Payton, Sean, Aidan, Dylan, Brady and Matthew.

Police Log March 8: Fraud, crashes and burglary

• Pennsylvania State Police from the Media barracks said the troop is looking for three black males who smashed windows of three unattended vehicles and stole three purses. Credit cards from those stolen purses were then used to make fraudulent purchases. The incidents took place on March 1, between 7:15 and 8:20 p.m. at Empowered Yoga and The Brandywine Racquet Club on Route 202 in Concord Township.

• On March 2, someone created two fake checks with the information of a Concord Township resident and fraudulently obtained $2,650 from the victim’s account.

• State police are saying speed was the cause of a one-car accident in East Marlborough Township on March 5. A report said Brandon M. Paris, 28, of Wilmington, was cited after he ran off Walnut Road, at East Locust Lane, and crashed into a fire hydrant at 2:16 a.m. No injuries were reported.

• State police said both drivers were cited for their involvement in a two-car crash in East Marlborough on Feb. 10. According to the report, Morgan N. Thrasher, 19, of West Grove, and Jonquil D. Patterson, 29, of Kennett Square, were charged. The crash happened at the Street Road entrance to the Landhope Farms. Police said Thrasher was heading east and was moving into the left hand lane of Street Road, while Patterson was exiting the store lot and tried to turn left to go west. Neither driver saw the other car because of a school bus that was stopped at the red light. Thrasher T-boned Patterson’s car, police said. Both cars were disabled, but no injuries were reported.

• Kennett Township police reported three burglaries in the township in March. On Feb. 8, someone stole various jewelry items from a home in the 800 block of Creek Road. On Feb. 16, unknown suspects gained entry into a home on Round Hill Road through a rear garage door window. Jewelry was stolen. Also on Feb. 16, someone entered a home on Kaolin Road through an open bedroom patio door. Police said the house had been rummaged through, but nothing was taken. If anyone has any information concerning these burglaries please dial 911 or call Kennett Township Police at 610-388-2874.
