Proposed legislation addresses digital assets

The Senate Judiciary Committee recently held a hearing to take testimony regarding Senator Dominic Pileggi’s  legislation addressing the management and disposition of digital assets after death, according to a press release from the senator.

Senate Bill 518 would establish the Fiduciary Access to Digital Assets Act, giving people the power to plan for their digital assets in the same manner they make plans for their tangible property by providing instructions in a will, trust, or power of attorney.

“For most people, at least some of their property and communications are stored as data on a computer server where access to these digital assets is usually governed by the terms-of-service agreement provided by a private company,” said Pileggi, R-9, in the release. “This can create problems when an account holder dies or otherwise loses the ability to manage their own digital assets. The intent of Senate Bill 518 is to simply extend a fiduciary’s authority to include a person’s digital assets.”

Senate Bill 518 would address four common types of fiduciaries: executors or administrators of deceased persons’ estates; court-appointed guardians or conservators of protected persons’ estates; agents appointed under powers of attorney; and trustees.

If a person fails to plan for the management and disposition of their digital assets, the same court-appointed fiduciary that manages the person’s tangible assets would have the discretion to manage the person’s digital assets.

The committee heard testimony from representatives of Facebook, Yahoo and NetChoice.

Pileggi said he believes that Pennsylvania must address fiduciary access to digital assets to keep pace with technology and will look for ways to do that in a way that protects the expectations of users while helping to ensure that estates are settled accurately.

ChesCo mosquito tests positive for West Nile

The Chester County Health Department is informing residents that a mosquito sample collected in Phoenixville Borough on June 10 has tested positive for West Nile Virus (WNV).

This is the first positive mosquito sample identified in Chester County for the 2015 season. The mosquito traps are placed in various locations in the county as part of routine surveillance by Health Department officials. The Health Department will continue to monitor these areas as well as surrounding areas and will consider control activities when appropriate, a county news release said.

The chance of contracting WNV from an infected mosquito is small and the chances of becoming seriously ill are even smaller; however, the Health Department recommends that individuals take personal precautions to minimize the possibility of being bitten by infected mosquitoes. This includes staying indoors at dawn or dusk when mosquitoes are most active, wearing long sleeve shirts and long pants when outside and using insect repellents when mosquitoes are active. The heightened concern will probably remain until the first frost which usually occurs in mid-October.

Residents are encouraged to take the following precautions to reduce mosquito breeding on their property:

  • Dispose of open containers that may collect water, such as tin cans, plastic containers, ceramic pots, etc.
  • Drill holes in the bottom of outdoor recycling containers so that water will not collect.
  • Keep your property clear of old tires.
  • Clean roof gutters, particularly if leaves from surrounding trees have a tendency to plug drains.
  • Turn over plastic wading pools when not in use.
  • Turn over wheelbarrows and don’t let water stagnate in birdbaths.
  •  Aerate ornamental pools or stock them with fish.
  •  Clean and chlorinate swimming pools when not in use. A swimming pool left untended by a family on vacation for a month can produce enough mosquitoes to result in neighborhood-wide complaints. Mosquitoes may even breed in the water that collects on pool covers.
  • For stagnant pools of water that cannot be removed or drained, homeowners can buy Bti products such as mosquito dunks at lawn/garden, outdoor supply, home improvement and other stores. This naturally occurring bacterial product kills mosquito larvae but is safe for people, pets, aquatic life and plants.

Stargazing, socializing to protect scenic vistas

Summertime stargazing and socializing at one of the region’s premier conservation sites await guests of Friday Night Lights, the popular event hosted by Natural Lands Trust (NLT) at the picturesque ChesLen Preserve.

Screen Shot 2015-06-16 at 1.27.57 AMNow in its fifth year, Friday Night Lights will take place on Friday, July 10, from 8 to 11 p.m. Black Horse Motel and New Sweden will provide live music.

In addition, expert astronomers from the Chesmont Astronomical Society and the Delaware Astronomical Society will train telescopes on faraway stars, inviting all to take a peek. Victory Brewing Company will provide its craft beer, local wines will be offered, and sweet and savory snacks will be served.

Guests should bring lawn chairs or a blanket and wear sturdy shoes as the ground is uneven. Dogs and coolers are not permitted, and the event is suitable for those ages 21 and older.

Advance ticket purchase is required. NLT members and WXPN members are $15 apiece; non-member tickets are $25. Proceeds benefit NLT’s many conservation initiatives.

Joseph C. Pesce of Kennett Square

Joseph C. Pesce, 91, of Kennett Square, died June 14 in Sidney, Ohio.

His parents were Joseph Pesce and Adelaide Brondo; born in the Liguria Province of Italy, both moved to the US in the early part of the twentieth century, settling along the Brandywine River in the Wilmington, Delaware area.

Joseph lived in Kennett Square throughout most of his life. He attended St. Patrick’s Catholic School and graduated from Kennett High School in 1941. In August 2013, he moved to Sidney, Ohio with his wife Edith, whom he married in 1947.

Joseph is survived by his wife Edith, his three children:  Robert J. Pesce, of Tampa, Fla., Dolores Pesce Wiley, of St. Louis, Missouri and her husband Bill, and Joseph M. Pesce of Chadds Ford, and his wife Diane; six grandchildren: Jennifer Pesce, Christina Pesce, Robert Pesce Jr., Nicole Pesce Fragale, Lisa Pesce, and Helen Julitta Pesce Wiley; and his sister Frances P. Lovisa of Merritt Island, Florida.

Joseph honorably served in the U.S. Army from July 1944 through June 1946, including 15-and-a-half months in the European Theater, where he was awarded four campaign medals. As a heavy mortar crewman, he was an ammunition handler, gunner, squad leader, and section sergeant in charge of two squads, responsible for their safety and conduct. When he began his military service, Joseph had completed three-and-a-half years of his college education at Villanova University; after his return from the war, he completed his Bachelor of Science degree in chemical engineering. Joseph worked for NVF Company in Yorklyn, Delaware and Kennett Square, for 42; his positions included technical manager and manager of process control.

Joseph was a lifetime member of St. Patrick’s Catholic Church of Kennett Square, the Kennett Fire Company, and the Italian-American Citizens League.  He also belonged to the Kennett Square Lions Club, the American Legion, the VFW, and the Kennett Square Golf and Country Club.

A private graveside service will be held at St. Patrick’s Cemetery.

Dorothy C. Fischer (nee Weatherly), of West Chester, died peacefully on June 12, at Wellington Terrace Nursing Home, where she had resided for the last two years.

Dorothy and her late husband, Norman, had previously lived in Downingtown.

She is survived by her sons, Bill (Maureen) and Jim (Dawn); her five granddaughters, Aimee Johnsonbaugh (Dennis), Kerry Eden (Patrick), Ashleigh Forwood (Jimmy), Casey Smith (Eric) and Abbie Fischer; and four great-grandchildren, Natalie Forwood, Nicholas Forwood, Brayden Smith and Ryan Eden. She is also survived by extended family whom we affectionately refer to as “The Pittsburghites” – the place where she and Norman grew up and started their family.

Dorothy enjoyed family and friends and, for many years, spent summers at their home in Ocean City, N.J.

She was a loving mother and grandmother to all and has many “adopted” grandchildren with whom she was always anxious to hear about and visit with. She had many more than those listed about who referred to her affectionately as “Mom-Mom.”
