With the upcoming summer season the Pennsylvania State Police urges residents to use caution when utilizing fireworks. The use of Consumer or Display fireworks in Pennsylvania is illegal unless a permit has been issued by the municipality in which the fireworks are going to be used. A general rule of thumb to go by when evaluating the legality of fireworks in Pennsylvania is “if it flies or explodes its illegal”. The only fireworks that are not regulated by PA State Law, that are permissible for use without a permit are defined as “Ground and Handheld Sparkling Devices,” “Novelties,” and “Toy Caps,” that fall under the American Pyrotechnics Association Standard 87-1. These types of fireworks are often sold at retail establishments and convenience stores and include items like sparklers, party poppers, snappers, toy smoke devices, snakes and glow worms, caps, and sparkling fountains.

Although firework usage is best left to the experts, if you decide to use sparklers or other novelties follow these safety precautions:
1.    Follow the instructions carefully
2.    Use only outside and in an open area
3.    Use only under responsible adult supervision
4.    Light only one item at a time
Place used items in a bucket of water prior to disposal

If a person is found to be in possession of, offering for sale, or using Consumer of Display fireworks in Pennsylvania the penalties are severe. Use of Consumer fireworks is a summary offense and can result in a fine of up to $100. The sale of Consumer fireworks is a misdemeanor and the sale of Display fireworks is a felony. Also, the sale of items including M-80’s and M-100’s, cherry bombs, and ¼ or ½ sticks of dynamite is a felony. All illegal fireworks can be immediately confiscated by any law enforcement officer. The Pennsylvania State Police urges residents to contact the police within their community to report the use of illegal fireworks in their area.
