FEKM to investigate election glitch

The law firm of law firm Fleck Eckert Klein McGarry has been appointed to investigate the Nov. 4 election day glitch that left more than 75,000 people off the election day roll books.

Third-party and non-affiliated voters had to file provisional ballots until new books were sent out later in the day of Nov. 4. The county said 12,600 provisional ballots were cast by voters whose names did not appear in the poll book. Affected voters included those registered as Independent, Libertarian, Green Party, Non-Partisan, and No Affiliation.

FEKM was one of 10 firms that were invited to submit proposals and was selected based on its experience in investigating election issues and its independence from Chester County Government.

The contract with FEKM will be a “not to exceed” contract with a $35,000 maximum.

According to a press release, Chester County CEO David Byerman said, the investigation will be a critical next step in restoring trust in the county’s democratic process.

“We deeply regret the errors that occurred on and before Election Day, and through this review, we commit to identifying the root causes of the problem and ensuring that it does not happen again,” he said.

The independent investigation will focus on five key questions:

1- What was the root cause of the production of incomplete poll books that led to the omission of third-party voters?
2- What processes and controls were in place within the Department of Voter Services to ensure poll book accuracy?
3- How and why did those processes fail? Were the processes and controls insufficient, or were they not properly followed?
4- What other factors contributed to the failure or impeded Voter Services staff from identifying or reporting concerns?
5- What caused the significant delays on Election Day as the County worked to mitigate the issue, and why weren’t supplemental poll books delivered to some polling places in a more timely manner?

FEKM will interview key personnel involved in poll book preparation, review, and distribution, and will evaluate internal controls and communication channels within the. Department of Voter Services.

The firm will identify causes and contributing factors of the poll book error; distinguish between human error and systemic deficiencies; and recommend improvements to oversight, accountability, and transparency in election operations.

Dr. Carl Wendell Lofland Jr., DDS, 95, of Kennett Square, died peacefully on Nov. 4. A lifelong resident of Kennett Square, Wendell was a proud graduate of Franklin and Marshall College and the University of Pennsylvania School of Dental Medicine. He served in the U.S. Air Force Dental Corps at Maxwell Air Force Base in Montgomery, Ala., before returning home to open his dental practice in Kennett Square, where he was a respected member of the business community. Wendell loved spending summers at the shore in Avalon, NJ, and was known for his dry sense of humor, long walks, and practical nature. A devoted dog lover, he never failed to stop and greet every dog he met.

Wendell is survived by his wife, Marilyn Lofland; his children, Marcie (Karl) Jorgensen and Rex Lofland; his grandchildren, Erik Jorgensen, Kyle (Courtney Rodgers) Jorgensen, Dylan (Eric Zullo) Lofland, Ryan Lofland, and Kelsey Jorgensen; and his great-grandchildren, Romeo Jorgensen and Crew Zullo.

Sandra Gale Laxton of West Grove

Sandra Gale Laxton

Sandra Gale Laxton, 57, of West Grove, died peacefully on Nov. 8 at her home in West Grove. She was the spouse of Steven D. Laxton, with whom she shared 25 years of marriage. Born in Elkton, Md., she was the daughter of the late Oscar Sells and the late Viola Rogers-Sells.

In her life, Sandy enjoyed traveling with her husband, hiking with their dogs, gardening, and visiting various historic museums. She loved to cook and feed people, often using her natural artistic creativity to bring some added design to the holiday meals.

Sandy was a member of the Church of the Brethren in West Grove. She enjoyed participating in Vacation Bible School. She was also a member of the CBN Christian Club and the 700 Club. Her donations helped people all over the world.

Sandy went to The Art Institute of Philadelphia, where she studied interior design and architecture. She was an excellent student and made the Dean’s List four times. She was a self-employed small businesswoman prior to her disability.

Sandy fought a long, courageous battle from Complex Regional Pain Syndrome (CRPS). Despite the long and painful battle with CRPS, Sandy never lost her faith in God. Sandy would often spend her time and experience educating and supporting CRPS sufferers in online support groups.

She will be remembered for her strength, kindness, empathy, compassion, passion, and creativity. She will be missed for her unwavering spirit, her generous heart, her bright creativity, and the deep love she shared with her family and friends. Her courage in the face of her long illness and her dedication to supporting others despite her own suffering will leave a lasting impact on all who knew her.

In addition to her husband, Steven, Sandy is survived by her son, Dewayne Swauger, and her sister, Cheryl Kaul. She was predeceased by her sister, Donna Adair.
