Charges waived in CF shooting

Richard Falcone, who was charged with three criminal counts had two of the charges completely waived and a third waived down to a misdemeanor in a Nov. 15 hearing. Falcone had been charged in connection with a Sept. 10 shooting incident on Webb Road.

Police were called in the early morning hours of that Saturday for reports of gunshots. Falcone eventually surrendered after a standoff of several hours.

The original charges included discharging a firearm into an occupied structure, recklessly endangering another person, and making terroristic threats. However, defense attorney Daniel McGarrigle and prosecutor Nick McGuire reached a negotiated waiver in which the first two charges were dropped and the third, terroristic threats, was waived to a misdemeanor.

Judge Wendy Roberts conducted the hearing and set Dec. 14 for an arraignment in the Court of Common Pleas.

The hearing was originally set for Sept. 20, then continued to Oct. 25, then continued again to Nov. 15. The original story can be found here.
